Terms of Use

1. Eligibility and Accounts

You may use the Service only if you can form a binding contract under applicable law. To access certain features, you may need to register an account and provide accurate information. You are responsible for maintaining the confidentiality of your login credentials, all activity under your account, and promptly notifying us of unauthorized use at contact@neunlist.com.

2. Our Service

Neunlist provides a platform for vehicle dealers to list inventory and for users to browse listings, create watchlists, and send inquiries. We may update, modify, or discontinue features at any time.

3. Dealer Subscriptions and Billing

Dealer access may require a paid subscription. Pricing, plan features, and billing terms are shown at signup or in the dealer account. Payments are processed by third-party payment providers (currently Stripe, off-site). We do not store full payment card details on our site. Unless otherwise stated, subscription fees are non-refundable.

4. User Content and Listing Content

Dealers and users may submit content, including listings, photos, messages, and inquiries. You represent that you have rights to submit that content and that it is accurate and lawful. You grant Neunlist a non-exclusive, worldwide, royalty-free license to host, display, reproduce, and distribute submitted content solely to operate and improve the Service.

5. Prohibited Conduct

• Violating any law or third-party right
• Posting false, misleading, or fraudulent content
• Interfering with the Service or security features
• Using bots or scraping without permission
• Uploading malware or harmful code
• Attempting unauthorized access to accounts or systems

6. Communications

By creating an account or opting in, you agree we may send service-related emails. Marketing emails are sent only where consent is provided and include unsubscribe options.

7. Intellectual Property

The Service, excluding user-submitted content, is owned by Neunlist and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer the Service except as permitted by law.

8. Third-Party Services

The Service may integrate with third-party providers, including Stripe, Google Analytics, and Mailchimp. Their services are governed by their own terms and privacy policies.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, to the fullest extent permitted by law. We do not guarantee uninterrupted service or that listings and information are always accurate.

10. Limitation of Liability

To the fullest extent permitted by law, Neunlist and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or use, arising from or related to the Service. Our total liability for claims relating to the Service will not exceed the amount you paid us in the 12 months before the claim.

11. Indemnification

You agree to indemnify and hold harmless Neunlist and its affiliates from claims, damages, and expenses arising from your use of the Service, your content, or your violation of these Terms.

12. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms or risk to the Service. You may stop using the Service at any time.

13. Governing Law

These Terms are governed by the laws of Oregon, USA, without regard to conflict of law principles, unless otherwise required by applicable law.

14. Changes to These Terms

We may update these Terms from time to time. Changes become effective when posted with a revised effective date. Continued use of the Service means you accept the updated Terms.
